{"id":15156,"date":"2025-11-06T14:53:37","date_gmt":"2025-11-06T13:53:37","guid":{"rendered":"https:\/\/araujobenetti.com\/urban-planning-law-and-tourism-alert\/"},"modified":"2026-06-17T14:04:03","modified_gmt":"2026-06-17T12:04:03","slug":"urban-planning-law-and-tourism-alert","status":"publish","type":"post","link":"https:\/\/araujobenetti.com\/en\/urban-planning-law-and-tourism-alert\/","title":{"rendered":"Urban planning law and tourism alert"},"content":{"rendered":"<p><strong><u>Decree Law 8\/2020, of May 13, on urgent and extraordinary measures to promote economic activity and administrative simplification in the area of \u200b\u200bthe Public Administrations of the Balearic Islands to alleviate the effects of the crisis caused by COVID-19.<\/u><\/strong><\/p>\n<p>Last Friday, May 15, Decree Law 8\/2020, of May 13, on urgent and extraordinary measures to promote economic activity and administrative simplification in the field of the Public Administrations of the Balearic Islands to alleviate the effects of the crisis caused by COVID-19, was published in the Official Gazette of the Balearic Islands (&#8220;BOIB&#8221;).<\/p>\n<p>This Decree is intended to \u201c<em>\u201cAchieve more effective and efficient functioning of the administrations of the Balearic Islands, to face the effects of the economic crisis that has occurred as a result of the health crisis caused by COVID-19.\u201d<\/em>. To this end, it establishes a series of measures that are aimed at simplifying certain obligations that the law imposes on administrations, individuals and companies and that, in turn, can provide an incentive for the development of economic activity affected by the crisis derived from COVID-19.<\/p>\n<p>Among the measures approved in urban and real estate matters, it is worth highlighting the following:<\/p>\n<p>1.- First of all,<strong><u>The application for a planning license for certain works and installations that have to be carried out on urban land is replaced by a responsible declaration addressed to the corresponding city council.<\/u><\/strong>This exceptional regime<u>It will be applicable until December 31, 2021.<\/u><\/p>\n<p>The exceptional regime established by art. 5 will apply to acts subject to urban planning license included in art. 146 of Law 12\/2017, of December 29, on Urban Planning of the Balearic Islands, provided that they are carried out in existing buildings and facilities on urban land that comply with urban planning. As an exception, it will not apply to: (i) works, acts and installations provided for in article 11.4 of Royal Legislative Decree 7\/2015, of October 30, which approves the consolidated text of the Land and Urban Rehabilitation Law, or other works that a state sectoral regulation subjects to the prior license regime, (ii) the coastal protection easement area, (iii) buildings in a situation outside planning, iv) the total demolition of constructions and buildings, (v) the works or interventions carried out in buildings or constructions that are assets of cultural interest or cataloged.<\/p>\n<p>Also excluded are the regime applicable to the end of works, first occupation or use of buildings and facilities, as well as acts subject to prior communication.<\/p>\n<p>2.- Secondly, article 7 includes a series of<strong><u>incentives for the modernization of tourist establishments.<\/u><\/strong>This aims to achieve two objectives: the promotion of the modernization of the industry as well as an increase in the productive sector related to renovations or constructions, which would have a clear impact on the increase in labor hiring. These measures will be<u>of application until December 31, 2021.<\/u><\/p>\n<p>Thus, the modernization works of tourist establishments remain<strong><u>exceptionally excluded from compliance with the territorial, urban and tourist planning parameters that prevent their execution, so that they will be legally incorporated into municipal planning as appropriate buildings, and their urban qualification will correspond to their specific volumetry and their tourist use.<\/u><\/strong>For this<u>A prior report from the competent tourist administration is required.<\/u>that proves that the modernization requests and the corresponding project have sufficient entity and relevance to reduce seasonality, the search or consolidation of new market segments or the improvement of complementary tourist services and a prior report from the tourism administration.<\/p>\n<p>The project may foresee the<strong><u>rearrangement or relocation of existing volumes, the use of the subsoil for habitable uses except for accommodation, and the redistribution of the number of authorized places<\/u><\/strong>. As a limit it is established that<u>In no case may it imply an increase in the number of accommodation places.<\/u><\/p>\n<p>It is also established that these works may provide for a<strong><u>relative increase in built area and occupancy<\/u><\/strong>, respectively,<u>as long as it does not exceed more than 15% of those legally built or currently permitted if they were greater, and does not represent a detriment to the services and facilities already implemented.<\/u><\/p>\n<p>3.- On the other hand, article 8 establishes that<strong><u>in the year 2020<\/u><\/strong><u> <strong>Summer time limitations will not apply to construction, modification, repair and demolition works related to the tourist season.<\/strong><\/u>that are in force in any regional, island or municipal regulations.<\/p>\n<p>4.- Finally, the 1st DA establishes the<strong><u>possibility that certain tourist accommodation establishments and buildings with non-residential uses may request their conversion and change to a use<\/u><\/strong><u>:<\/u>(i) residential, intended exclusively for officially protected housing, (ii) for social-health or care facilities, public or private (including nursing homes, day centers, centers for the disabled and dependents and similar), (iii) administrative, considering specific uses associated with scientific research, development and technological innovation (R&amp;D&amp;I) projects as preferential.<\/p>\n<p>However, we must note that on Monday, June 1, its processing as a bill passed in Parliament, so<u>It is likely that changes will be introduced as a result of negotiations between the different parliamentary groups.<\/u><\/p>\n<p>In our office we have the experience and training necessary to resolve any issues that may arise as a result of the application of this regulation, do not hesitate to contact us.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Decree Law 8\/2020, of May 13, on urgent and extraordinary measures to promote economic activity and administrative simplification in the area of \u200b\u200bthe Public Administrations of the Balearic Islands to alleviate the effects of the crisis caused by COVID-19.
