Legislative Decree 1\/2020, of August 28, which approves the consolidated text of the Environmental Assessment Law of the Balearic Islands<\/strong><\/p>\n

On August 29, it was published in the Official Gazette of the Balearic Islands (hereinafter, \u201cBOIB<\/strong>“) Legislative Decree 1\/2020, of August 28, which approves the consolidated text of the environmental assessment of the Balearic Islands (hereinafter, “TRLEA<\/strong>“).<\/p>\n

The TRLEA, which came into force the day after being published in the BOIB (that was, on August 30, 2020), has been prepared in application of the third final provision of Law 9\/2018, of July 31, which modifies Law 12\/2016, of August 17, on environmental evaluation of the Balearic Islands, and its purpose is to regulate the environmental evaluation of plans, programs and projects. that may have significant effects on the environment in the Balearic Islands, in the exercise of the powers established in article 30.46 of the Statute of Autonomy of the Balearic Islands, and within the framework of the basic legislation contained in Law 21\/2013, of December 9, on environmental evaluation, and the applicable European directives, without prejudice to the powers that correspond to the General Administration of the State in accordance with the basic state legislation.<\/p>\n

The TRLEA consists of six titles, including the preliminary one, adapting to the architecture of the basic legislation, two additional provisions, one transitional provision, three final provisions and two annexes.<\/p>\n

The preliminary title, in addition to establishing the object and scope of the law, also includes, in the purposes of the norm, the principles of international, European and basic legislation. Likewise, the commitment to participation, transparency and electronic administration, and the conflict between advertising and data confidentiality, are regulated.<\/p>\n

Title I deals with inter-administrative cooperation and regulates the configuration of the Environmental Commission of the Balearic Islands as the environmental body of the Autonomous Community.<\/p>\n

Title II regulates the scope of application of the strategic environmental assessment (ordinary and simplified) and the environmental impact assessment (ordinary and simplified), as well as the assumptions excluded from the environmental assessment and excludable projects. In this regard, it is clarified that the possibilities of exclusion regulated in this article will not exempt the promoter from carrying out an evaluation of the repercussions on the Red Natura 2000 spaces in the case of plans, programs or projects that, without having a direct relationship with the management of the place or without being necessary for it, can appreciably affect the species or habitats of said spaces, either individually or in combination with other plans, programs or projects. Finally, the nullity of plans, programs and projects that are not subject to environmental evaluation is established, as well as the invalidity and ineffectiveness of responsible declarations or prior communications that do not require environmental evaluation.<\/p>\n

Title III regulates environmental evaluation procedures. As highlighted in the Explanatory Memorandum of the TRLEA, the documentation of the environmental impact studies includes, in addition to the minimum content established by the basic law, an annex of landscape incidence, taking into account both the asset that the landscape represents in the Balearic Islands and the validity of the European Landscape Convention, approved by the Council of Europe on October 20, 2000, which came into force in Spain on March 1, 2008. An annex consisting of a study is also included. on the direct and induced impact on energy consumption, peak demand and greenhouse gas emissions, as well as vulnerability to climate change.<\/p>\n

Title IV deals with the evaluation of the repercussions on the Natura 2000 Network spaces.<\/p>\n

The monitoring of environmental procedures, the protection of environmental legality, the reestablishment of the disturbed legal order and the sanctioning regime are regulated in title V.<\/p>\n

Additionally, it should be noted that, in the first additional provision, this consolidated text regulates nature conservation banks, granting the competence for their creation to the counselor competent in environmental matters. For its part, the second and third final provisions modify Law 12\/2017, of December 29, on urban planning of the Balearic Islands and Law 11\/1998, of December 14, on the specific fee regime of the Autonomous Community of the Balearic Islands, respectively.<\/p>\n

Finally, the annexes of the projects submitted to environmental evaluation are collected.<\/p>\n

Regarding the repealing regime, this consolidated text, in addition to the generic repealing clause, specifically repeals Law 12\/2016, of August 17, on environmental evaluation of the Balearic Islands, Law 9\/2018, of July 31, which modifies Law 12\/2016, of August 17, section 4.a) of the sole article of Law 5\/2012, of 23 May, of urban planning measures for the execution of the Rafael Nadal International Tennis Center – in accordance with the opinion of the Consell Consultiu it has been specified that this repeal will affect the environmental evaluations that begin from the entry into force of the legislative decree -, and section f) of article 124.1 of Law 11\/1998, of December 14, on the specific tax regime of the autonomous community of the Balearic Islands.<\/p>\n

Note that, as provided in the single transitional provision, the TRLEA applies to all environmental assessments that begin after its entry into force. On the other hand, the environmental impact statements published prior to the entry into force of Law 12\/2016 lose validity and cease to produce their own effects if the execution of the project or activity has not begun within the maximum period of six years from the entry into force of said law. In this case, the promoter must start the environmental evaluation process of the project again in accordance with this consolidated text.<\/p>\n
