{"id":15222,"date":"2025-11-06T14:53:28","date_gmt":"2025-11-06T13:53:28","guid":{"rendered":"https:\/\/araujobenetti.com\/alert-waste-and-contaminated-soil-law-of-the-balearic-islands\/"},"modified":"2026-06-17T14:11:18","modified_gmt":"2026-06-17T12:11:18","slug":"alert-waste-and-contaminated-soil-law-of-the-balearic-islands","status":"publish","type":"post","link":"https:\/\/araujobenetti.com\/en\/alert-waste-and-contaminated-soil-law-of-the-balearic-islands\/","title":{"rendered":"Alert: Waste and Contaminated Soil Law of the Balearic Islands."},"content":{"rendered":"<p>April 2019<\/p>\n<p>On February 21, 2019, the Official Gazette of the Balearic Islands published the<a>Law<\/a>8\/2019, of February 19, on waste and contaminated soils of the Balearic Islands (hereinafter, \u201c<strong>LRSCIB<\/strong>&#8220;).<\/p>\n<p>This regulation completes what is established in the basic state regulations, essentially contained in Law 22\/2011, of July 28, on waste and contaminated soils, increasing in certain aspects the levels of environmental protection, and adapting said regulations to the peculiarities of the Balearic archipelago.<\/p>\n<p>There are many issues that the LRSCIB addresses, and many implications that arise from it for the actors involved. There is no doubt that this is an important norm within our autonomous system, since the proper management of waste has become one of the main environmental and social challenges that we face today, both at a global and regional level.<\/p>\n<p>Among the forecasts contained in the LRSCIB, we want to highlight the following:<\/p>\n<p><strong>A) Obligations regarding waste collection, preparation for reuse, recycling and recovery (art. 29):<\/strong><\/p>\n<p>Among other measures, the following are established:<\/p>\n<p>Every public or private establishment must have established the separation at source of its waste.<\/p>\n<p>The obligation to separate waste at source must necessarily be provided for in public and private contracts for the maintenance and cleaning of buildings since the promulgation of the LRSCIB.<\/p>\n<p>The separate collection of waste that must be carried out by local authorities must include, at a minimum, the fractions of paper, metal, plastic, glass, compostable organic matter, prunings, textiles and vegetable oil. All other mandatory items by regulation, such as electrical and electronic appliances, bulky items, construction and demolition waste, etc., will also be collected separately.<\/p>\n<p>Local entities have a period of 24 months from the entry into force of the LRCSL to implement the differentiated collection of compostable organic matter, pruning, used vegetable oil, textile waste and hazardous waste, all of household origin.<\/p>\n<p>Tourism establishments and companies in the HORECA sector have to enable the separate collection of the aforementioned fractions, especially the organic fraction of dining room and kitchen waste, once the municipalities have adapted to the collection of the new waste fractions, as well as vegetable oils.<\/p>\n<p>Ships that, using port services, unload waste in the ports of the Balearic Islands must follow the same separation criteria established in art. 29 of the LRSCIB.<\/p>\n<p><strong>B) Competence regime regarding waste (Chapter I of Title II):<\/strong><\/p>\n<p>The<a>LRSCIB<\/a>It tries to provide clarity to the distribution of powers in matters of waste, trying to put an end to the debates and conflicts that have been occurring on this matter. In relation to the distribution of powers, the following is established, among other issues:<\/p>\n<p>The Government of the Balearic Islands maintains competence in hazardous waste planning, the authorization, surveillance, inspection and sanction of waste production and management activities, the transfer of waste and the regulatory and normative development power in the area regulated by the LRSCIB.<\/p>\n<p>The island councils maintain the competence in non-hazardous waste planning that they are exercising, the island treatment of the organic fraction of domestic waste, the coordination of the collection of domestic waste in municipalities with less than 20,000 inhabitants, in the terms specified in the local regime legislation; and the treatment, if applicable, of the rest of non-hazardous waste in the manner established by the sectoral master plans for the prevention and management of non-hazardous waste.<\/p>\n<p>Municipalities must provide as a mandatory service the collection and transportation of non-hazardous and hazardous household waste generated in citizens&#8217; homes, businesses and services. As a non-mandatory service, it is up to the municipalities to collect and transport non-hazardous commercial waste and non-hazardous domestic waste from industries, without prejudice to the provisions of article 12.5.c).2 of Law 22\/2011, as long as the municipalities can manage it themselves.<\/p>\n<p>Likewise, they are responsible for the exercise of the power of surveillance and inspection and of the power to sanction within the scope of their powers.<\/p>\n<p><strong>C)<\/strong><strong>Regulation regarding single-use products and other products (arts. 23 and 24):<\/strong><\/p>\n<p>Starting January 1, 2021, the following measures will be adopted:<\/p>\n<p>Commercial establishments will not be able to distribute light, single-use plastic bags. Preferably, other materials will be used and only very light compostable plastic containers or bags may be distributed, as long as they are intended only for food products to prevent waste and\/or for hygiene or safety issues.<\/p>\n<p><strong><\/strong><\/p>\n<p>The sale, distribution and use of single-use plates, cutlery, glasses, cups and food trays made of plastic that do not fall within the scope of Directive 94\/62\/EC on packaging and packaging waste will not be permitted, except for those that are compostable.<\/p>\n<p>Single-dose food products may not be used, with the exception of those restrictions established by Royal Decree 895\/2013, nor single-use utensils in establishments and tourist companies in the HORECA sector for the consumption of food and beverages in the same premises, with the exception of cellulose consumables.<\/p>\n<p><strong><\/strong><\/p>\n<p>Only beverage straws, ear sticks and candy sticks made from compostable materials may be distributed, marketed and used in the Balearic Islands.<\/p>\n<p>Single-use capsules for coffee, infusions, broths and others used in coffee machines, offered for sale in the Balearic Islands, will have to be manufactured with compostable or easily recyclable materials, organically or mechanically.<\/p>\n<p>The distribution and sale of Products containing microplastics and nanoplastics, and non-reusable and non-refillable versions of printer and photocopier cartridges and toners, will be prohibited.<\/p>\n<p><strong>D) Packaging prevention measures (art. 25):<\/strong><\/p>\n<p>In general, beverages in single-use containers may not be distributed in buildings and facilities of administrations and public entities, regardless of their management modality, as of January 1, 2021. Drinking water sources will be installed and kept operational in these spaces under conditions that guarantee hygiene and food safety. Alternatively, water may be supplied in reusable containers, without prejudice to the fact that health and educational centers may allow sales in single-use containers. The glasses supplied will preferably be reusable or, in any case, compostable.<\/p>\n<p>In public events, including sports events, that have the support of public administrations, whether in sponsorship, organization or any other formula, alternatives to the sale and distribution of packaged drinks and single-use glasses must be implemented and, in any case, access to unpackaged water or in reusable bottles must be guaranteed. In addition, a deposit system must be implemented to avoid the abandonment of containers and glasses or their incorrect management.<\/p>\n<p>In establishments in the HORECA sector, consumers, clients or users of their services must always be offered the possibility of consuming unpackaged water free of charge and complementary to the offer of the establishment itself, provided that the city council or the water supply company guarantees that it is suitable for human consumption and that it therefore presents the required sanitary conditions.<\/p>\n<p>Packages of cans or bottles of beverages held by plastic rings or other secondary collective packaging cannot be distributed, which, in any case, will have to be made of biodegradable material and so indicate to the consumer as of January 1, 2021.<\/p>\n<p><strong>E) Creation of the Waste Authority of the Balearic Islands (arts. 34 and 35):<\/strong><\/p>\n<p>The Government of the Balearic Islands will propose to Parliament, no later than 24 months from the entry into force of the LRSCIB, the creation of the Waste Authority of the Balearic Islands, attached to the department responsible for the environment.<\/p>\n<p>The institutional purposes of the Waste Agency of the Balearic Islands will be, among others, the following:<\/p>\n<p><u>a) The management of the Waste Prevention and Management Fund<\/u>. <\/p>\n<p>This fund is regulated in art. 33 of the LRSCIB, and is intended to finance measures that aim to mitigate the adverse impacts on human health and the environment associated with the generation and management of waste.<\/p>\n<p><u>b) The creation of the Waste Prevention Office.<\/u><\/p>\n<p>The functions of the Waste Prevention Office will be, as established in art. 35.4 of the LRSCIB the following:<\/p>\n<p>The promotion of prevention.<\/p>\n<p>The promotion of reuse and recycling, other forms of material recovery and all those measures provided for in article 22.2 of the LRSCIB.<\/p>\n<p>The waste and circular economy data observatory, which will promote the characterization of waste and other information necessary for the calculation of objectives.<\/p>\n<p>The investigation of alliances between the agents involved in waste management.<\/p>\n<p>The creation and revitalization of working groups on waste.<\/p>\n<p>Monitoring of the sectoral master plans and waste prevention and management programs of the Balearic Islands.<\/p>\n<p>Channeling general consultations on waste and the circular economy.<\/p>\n<p>The promotion of communication, awareness and environmental education campaigns on good waste practices.<\/p>\n<p>Support the town councils in everything involved in the development of the LRSCIB.<\/p>\n<p><strong>F) Creation of the Waste Production and Management Registry of the Balearic Islands (art. 37):<\/strong><\/p>\n<p>The Waste Production and Management Registry of the Balearic Islands is created, whose data must be incorporated, where appropriate, into the Waste Production and Management Registry of the ministry responsible for the environment.<\/p>\n<p><strong>G) Transfer of waste (art. 50):<\/strong><\/p>\n<p>Since the entry into force of the LRSCIB, the import of waste destined for public treatment plants located in the territory of the Balearic Islands is prohibited.<\/p>\n<p><strong>H) Obligations in relation to education, training and awareness by administrations (art. 8):<\/strong><\/p>\n<p>Administrations, within the framework of their powers, must carry out certain actions to achieve the objectives established in the LRSCIB, including the following:<\/p>\n<p>Carry out specific actions to inform citizens regarding the need not to confuse the selective collection of vegetable and mineral oils.<\/p>\n<p>Promote awareness-raising actions to avoid the abandonment of waste and prevent the degradation of natural terrestrial spaces and marine ecosystems, as well as urban ones, in order to guarantee the conservation of soils and promote their regeneration.<\/p>\n<p>Promote training and specialization courses for both administration personnel, especially for officials who have to act in the field of surveillance and inspection, as well as for production companies and professional waste managers.<\/p>\n<p><em>The content of this Alert is for informational purposes only.
