Decree 33\/2015, of May 15, which definitively approves the modification of the Energy Sector Master Plan of the Balearic Islands.<\/strong><\/p>\nOn May 16, Decree 33\/2015, of May 15 (hereinafter, “Decree 33\/2015”) was published in the Official Bulletin of the Balearic Islands (hereinafter, the “BOIB”), which definitively approves the modification of the Energy Sector Master Plan of the Balearic Islands (hereinafter, the “PDSEIB”), approved by the Decree. 96\/2005, of September 23, definitive approval of the review of the PDSEIB. Decree 33\/2015 came into force the day after its publication in the BOIB, that is, May 17, 2015.<\/p>\n
The ultimate objective of Decree 33\/2015 is to increase the production of electrical energy from renewable sources in the Balearic Islands to comply with European, state and regional provisions relating to the reduction of CO2 and the promotion of renewable energies.<\/p>\n
The modification of the PDESIB that is approved with Decree 33\/2015 consists of the incorporation into the current text of the aforementioned Plan of Chapter VIII, the purpose of which is to define the territorial planning of renewable energies in the Balearic Islands through the establishment of the zones of environmental and territorial suitability for the implementation of photovoltaic solar energy installations (hereinafter, “photovoltaic”) and terrestrial wind energy hereinafter, \u201cwind\u201d), promoting a distributed and sustainable energy model, and incorporating preventive and corrective measures for possible environmental and landscape impacts. The main new features introduced in the aforementioned Chapter VIII are the following:<\/p>\n
The 1st Decree 33\/2015 mentions the following provisions: (i) Kyoto Protocol on climate change of the United Nations Framework Convention on Climate Change (UNFCCC), which was initially adopted in Kyoto on December 11, 1997, which was ratified by the Spanish State on May 10, 2002, coming into force on February 16, 2005, and which establishes as a binding objective at the European Union level to achieve at least 27% of renewable energies in 2030; (ii) the Spanish Climate Change and Clean Energy Strategy,<\/p>\n
Horizon 2007-2012-2020, approved in 2007; and (iii) the Balearic Climate Change Strategy, which was approved on April 8, 2013 by the Interdepartmental Commission on Climate Change of the Government of the Balearic Islands, and which includes the Climate Change Mitigation Action Plan 2013-2020 and the Action Plan to Fight Climate Change 2008-2012; and (iv) the document \u201cRenewable energies and energy efficiency in the Balearic Islands: strategies and lines of action\u201d, prepared in 2013 by the Directorate of Industry and Energy of the Government of the Balearic Islands, and which establishes that a modification of the PDSEIB is necessary in relation to renewable energies.<\/p>\n
(i) Four environmental and territorial suitability zones are established for the implementation of photovoltaic and wind installations (high suitability zone, medium suitability zone, low suitability zone and exclusion zone).<\/p>\n
(ii) Regarding photovoltaics, a distinction is made between installations on the roof or integrated into the building and installations on the ground, favoring the implementation of photovoltaics on roofs and small installations.<\/p>\n
(iii) Regarding wind energy, microwind installations are encouraged (installations<\/p>\n
formed by wind turbines with a unit power of less than 10 KW and a total power of no more than 100KW) in urban spaces, preserving the Tramuntana mountain range and other unique environments for the development of larger wind farms.<\/p>\n
(iv) A series of environmental conditions are imposed on renewable energy installations aimed at preventing or reducing the probable negative effects of these installations (Annex F), which must be respected along with the applicable sector regulations.<\/p>\n
(v) The need is established to specifically evaluate, in the public utility declaration or environmental impact assessment procedure, the cumulative effect of the projects due to<\/p>\n
The determinations established in the new chapter VIII of the PDESIB will be in force as long as the energy contribution of the renewable energy installations of the Balearic electricity system is less than 27% of the total demand of the system. Exceeding the indicated limit will mean the need to review the PDESIB again.<\/p>\n
