COMPUTER SYSTEM FAILURE IN THE PROCEDURE FOR ACQUIRING ETV TOURIST PLACES IN MALLORCA: THE PROCEDURE WILL HAVE TO BE RESTARTED

The procedure opened in September for applications for ETV tourist places in Mallorca will have to be repeated due to computer incidents that prevented the correct processing of the applications submitted.

As we explained in another post, Transitional Provision Two of Decree-law 4/2025, of 11 April, created two pools of temporary tourist places: one for hotel establishments and another for holiday rental dwellings (ETV).

In Mallorca, the Resolution of the Governing Board of the CBAT of 9 June 2025 approved the conditions, requirements, procedures and prices for access to the tourist places included in those pools, and set the first call for the acquisition of ETV places for 1 September of this year.

However, an initial computer failure prevented the procedure from opening on that date. At 8:45 a.m. there was a general outage of the CL@VE online identification system. For that reason, and given the risk of breaching the principle of equality among applicants, the president of the CBAT decided to postpone the start of the call until the following day, 2 September 2025.

New computer incidents were recorded that same day which, after a few initial minutes of apparent normality, made it impossible to submit and register applications. Despite the difficulties suffered by users trying to take part in the procedure, the call remained open.

It has now been reported that the high number of applications registered on 2 September caused the system to collapse, making it impossible to determine the exact order and validity of the applications submitted. In view of this situation, the president of the CBAT has issued a Resolution declaring that it is impossible to resolve the procedure and ordering it to be repeated, due to a possible breach of the principle of equality among interested citizens.

The Administration also reserves the possibility of reformulating the award criteria through a new Agreement of the Governing Board of the CBAT.

Given that a very high number of applications was foreseeable, it is striking that the necessary measures had not been adopted to guarantee effective equality among interested parties, either through a more robust computer system or through legal mechanisms other than the mere chronological order of submission.

The repeated technical failures in procedures of this importance highlight the need to review the means and criteria used to manage public calls, especially when they affect a sector as sensitive as tourism.
