Order HAC/1272/2019, of December 16, which publishes the limits of the different types of contracts for the purposes of public sector contracting as of January 1, 2020.
In the Official State Gazette (BOE) of December 31, 2019, Order HAC/1272/2019, of December 16, was published, which publishes the limits of the different types of contracts for the purposes of public sector contracting as of January 1, 2020 (hereinafter, “Order HAC/1272/2019“).
In accordance with the provisions of the eleventh additional provision of Law 9/2017, of November 8, on Public Sector Contracts (hereinafter, “LCSP“), the third final provision of Law 31/2007, of October 30, on contracting procedures in the water, energy, transport and postal services sectors (hereinafter, “Law 31/2007“), and the second additional provision of Law 24/2011, of August 1, on public sector contracts in the fields of defense and security (hereinafter, “Law 24/2011“), Order HAC/1271/2019 incorporates into Spanish legislation the limits set by the European Commission in these areas.
Specifically, it is determined that, as of January 1, 2020, the thresholds for the purposes of applying the contracting procedures are the following:
1. Regarding theLCSP: a) Regarding works contracts, works concession contracts and service concession contracts, the figure of 5,548,000 euros cited in articles 20.1, 23.1.a) and 318 b) is reduced to that of5,350,000 euros; b) Regarding service and supply contracts, the figure of 221,000 euros cited in articles 21.1.b), 22.1.b), 23.1.b) and 318 b) is reduced to that of214,000 euros; c) Regarding service and supply contracts, the figure of 144,000 euros cited in articles 21.1.a) and 22.1.a) is reduced to that of139,000 euros.
2. Regarding theLaw 31/2007: a) Regarding works contracts, the figure of 5,548,000 euros referred to in article 16.b) is reduced to that of5,350,000 eurosin. b) Regarding supply and service contracts and project competitions, the figure of 443,000 euros referred to in articles 16.a) and 95.1 is reduced to that of428,000 euros.
3. Regarding theLaw 24/2011: a) Regarding works contracts, the figure of 5,548,000 euros cited in article 5.b) is reduced to that of5,350,000 euros;b) Regarding supply and service contracts, the figure of 443,000 euros referred to in article 5.a) is reduced to that of428,000 euros.
The Decree regulates the generic powers of the executive directors of the Council of Mallorca – which add to those conferred by the Organic Regulations of the Council of Mallorca – as well as the powers of the various Departments, and the entities attached to them.
The Decree repeals the Presidential Decree of July 16, 2019 and any provision of equal and lower rank that opposes or contradicts what it provides and establishes its entry into force on the same day of its publication in the BOIB (this was December 12, 2019.
